Terms and Conditions / General Terms and Conditions (GTC)

for the BabyTritt Website

I. Scope of Application

These Terms and Conditions govern the use of the website www.babytritt.com (hereinafter referred to as the “Website”) and the business relationship between you as a user of the Website (hereinafter referred to as the “Customer”) and us as the operator of the Website (BabyTritt, K+D Global GmbH, Spitalstrasse 18, 5737 Menziken, Switzerland).
Use of the Website is permitted only subject to these Terms and Conditions. By using the Website, you agree to these Terms and Conditions.

II. Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to place an order.
By clicking the “Buy” button, you submit a binding order for the goods contained in your shopping cart. Confirmation of receipt of your order is generated automatically and does not yet constitute acceptance of the contract.
A contract is concluded only when we accept your order by sending a separate order confirmation by email or by dispatching the goods within 5 business days.

III. Prices and Payment Terms

All prices stated on the Website are in U.S. Dollars (USD) and include the applicable statutory value-added tax (VAT), plus shipping costs.
Payment may be made using the following methods:
  • Credit card (Visa, Mastercard)
  • PayPal
  • Twint
  • Advance payment (bank transfer)
If the payment method PayPal is selected, payment processing is carried out by PayPal (Europe) S.à r.l. et Cie, S.C.A., 22–24 Boulevard Royal, L-2449 Luxembourg, in accordance with PayPal’s terms and conditions.

IV. Delivery Terms

Delivery is made within 3–7 business days after conclusion of the contract to the delivery address provided by the Customer, unless otherwise stated on the product page.
For consumers, the risk of accidental loss or accidental deterioration of the goods passes to the Customer only upon delivery of the goods.

V. Warranty and Liability

The statutory warranty rights apply. The warranty period is 2 years from delivery of the goods. For used goods, the warranty period may be reduced to 1 year.
We shall not be liable for damage resulting from improper use or handling of the goods by the Customer.

VI. Right of Withdrawal

Customers in the European Union have a statutory right of withdrawal of 14 days.
Further details can be found in our Withdrawal Policy, which forms an integral part of these Terms and Conditions.
Customers in Switzerland are granted a voluntary right of return of 14 days in accordance with our Return and Refund Policy.
Customers in the United States are granted a voluntary right of return of 14 days from the date of delivery, in accordance with our Return and Refund Policy. This is a voluntary policy and not a statutory right.

VIII. Final Provisions

Swiss law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
For consumers residing in the EU or Switzerland, the mandatory statutory places of jurisdiction shall apply. In all other cases, the exclusive place of jurisdiction for all disputes shall be the registered office of K+D Global GmbH, 5737 Menziken, Switzerland.
Should any provision of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
